Terms & Conditions
Last updated: September 1, 2026
These Terms & Conditions ("Terms") govern your use of Beacon (beaconsped.org), an AI assistant for special education teachers. Beacon is sold and operated by Cody Priest ("we," "us," or "our"). By using Beacon, you are contracting with Cody Priest, and by continuing to use the service you agree to these Terms.
Draft notice: This page is a working draft prepared for merchant onboarding and will be reviewed by legal counsel before final publication.
The service
Beacon is an AI drafting and explanation assistant for special education professionals. It helps you draft and refine documents such as IEP goals, PLAAFP statements, accommodations, behavior plans, and parent communications.
Beacon includes a free trial of up to five messages. Continued use requires a paid subscription ("Beacon" or "Beacon + Harbor").
AI-generated content — no professional advice
Beacon generates content using artificial intelligence. All outputs are drafts intended for your review. Beacon is not a lawyer, advocate, educational authority, or compliance officer, and its outputs are not legal, medical, or compliance advice. They create no guarantee of regulatory compliance.
You are responsible for reviewing, verifying, and editing every output before using it with real students, families, or school records. You are responsible for your prompts and inputs and for ensuring you have the right to share any content you enter.
Eligibility and accounts
You must be at least 18 years old to use Beacon and must have the authority to bind any organisation on whose behalf you act. You are responsible for providing accurate information at checkout and for any activity that occurs using your subscription.
Acceptable use
You must not misuse Beacon. You agree not to:
- Use Beacon for any unlawful purpose, fraud, or spam;
- Infringe anyone's intellectual property rights;
- Interfere with the security or operation of the service (including introducing malware, probing, or scraping it);
- Attempt to extract Beacon's system prompts or reverse engineer the service;
- Resell, redistribute, or circumvent usage limits or technical restrictions.
Intellectual property
We retain all ownership of Beacon, including its software, design, documentation, and branding. We grant you a limited, non-exclusive, non-transferable licence to use Beacon within the plan you selected. Subject to your rights in your own inputs, you may use the outputs Beacon generates for you in your professional work. If you believe content on Beacon infringes your rights, contact us and we will investigate and may remove or restrict the content.
Payments, billing, and subscriptions
Subscriptions renew automatically at the selected interval (monthly or annually) until cancelled. You may cancel at any time; cancellation takes effect at the end of the current paid period. Prices are shown at checkout and may change on renewal with advance notice. Payments are processed by Stripe, our payment processor; card details are handled by Stripe and never stored by us. Applicable sales tax, where required, is the responsibility of Beacon as the seller. See our Refund Policy for how refunds work.
Seller and merchant of record
Beacon is sold by Cody Priest, who is the merchant of record for all orders and is responsible for the transaction, applicable sales tax, customer service, and refunds. Stripe acts solely as our payment processor and is not a party to your agreement with us.
Service availability and warranties
We do not guarantee that Beacon will be uninterrupted, error-free, or always available. To the fullest extent permitted by law, Beacon is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, our aggregate liability to you is capped at the fees you paid for Beacon in the 12 months before the claim, and we are not liable for indirect, consequential, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where the law does not allow it.
Suspension and termination
We may suspend or terminate your access to Beacon for a material breach of these Terms, non-payment, a security or fraud risk, or repeated or serious violations of our acceptable use rules. Because Beacon does not store your content, there is no account data to export when access ends.
Governing law and jurisdiction
These Terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts of Comal County, Texas, except where mandatory consumer protections in your jurisdiction provide otherwise.
General
Mandatory consumer protections in your jurisdiction continue to apply. You may not assign these Terms without our consent; we may assign them in connection with a merger or acquisition. We are not liable for failures caused by events beyond our reasonable control.
